Modernization and globalisation have aided in the development of India as a technologically advanced nation, but certain constitutional ideals no longer meet the essence of time and the needs of the elderly to live in dignity. This article aims to highlight the social and legal issues that aged persons face in terms of living with dignity and deprivation of basic rights, as well as the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 (MWP Act) and its failure to protect the rights of aged persons in India. Issues and challenges related to the MWP Act's implementation are discussed, and remedies in the form of recommendations are pen down and attempted. Aged persons are vulnerable groups in the society and easily exposed to atrocities and exploitations.
